Terms of Service

1. Agreement and operator
These Terms govern your access to Lenscap, including its website, creative tools, subscriptions, credits, and related services. Lenscap is operated by Audity Labs LLC, a Colorado limited liability company (“Lenscap,” “we,” “us,” or “our”). By creating an account, purchasing a plan or credit pack, or using the service, you agree to these Terms, the Privacy Notice, and the AI Content Policy. If you use Lenscap for an organization, you represent that you may bind it to these Terms.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract. Account information must be accurate and current. You are responsible for activity under your account and for protecting your sign-in credentials. Notify us promptly if you believe your account has been accessed without permission. You may not sell, transfer, or share an account in a way that defeats plan limits or security controls.
3. The service
Lenscap provides browser-based tools for generating and preparing AI images and videos, including tools for projection mapping and visual installations. Features, models, limits, and availability can change as the service evolves. Generation relies on third-party providers and may be delayed, rejected, interrupted, or unavailable. AI output is probabilistic: the same prompt can produce different results, and a completed result might not match your creative intent.
Lenscap is a creative tool, not professional legal, medical, financial, engineering, safety, or architectural advice. Review every output before relying on, publishing, selling, or projecting it.
4. Credits
Generations use the number of credits displayed before submission. Credits are limited service entitlements, have no cash value, and are not transferable or redeemable for money except where law requires. Subscription credits expire at the next monthly refresh and do not roll over. Purchased credit-pack credits expire twelve months after purchase. Welcome, promotional, and other complimentary credits ordinarily expire ninety days after issue unless a different date is shown. Credits with the earliest expiration are used first.
When a generation is confirmed to have failed after credits were deducted, Lenscap returns the originating credits once. Returned credits keep their original expiration date or receive at least seven additional days, whichever is later. An ambiguous provider response may remain pending while we determine whether the provider processed the request; repeatedly submitting the same job can create additional charges and outputs.
5. Subscriptions, renewals, and taxes
Monthly subscriptions are charged when purchased and automatically renew at the disclosed monthly price until canceled. Annual subscriptions are charged for the full year when purchased and automatically renew annually; the included credits are released in monthly installments rather than all at once. Prices are shown in U.S. dollars unless checkout states otherwise. Applicable taxes may be added or included as indicated at checkout.
Before purchase, checkout identifies the plan, price, billing period, renewal terms, and how to cancel. You authorize Stripe to charge your selected payment method for the initial purchase and each renewal. You can stop future renewal online through Account → Manage billing. Cancellation does not require a telephone call and ordinarily takes effect at the end of the paid term. Details are in our Refund & Cancellation Policy.
6. Refunds, disputes, and payment reversals
An initial subscription purchase or an unused credit pack may be eligible for a refund when requested within seven days and none of the associated paid credits have been used. Renewals and partially used purchases are ordinarily non-refundable. Duplicate, incorrect, or unauthorized charges are reviewed separately. These rules do not limit mandatory refund, cancellation, or withdrawal rights.
A refund, chargeback, or payment dispute may remove unused credits attributable to that payment. If those credits were already spent, generation and additional purchases may be paused while we document payment recovery, resolve the dispute, or waive the amount. Lenscap does not create an automatic negative credit balance.
7. Your uploads and permissions
You keep ownership of your prompts, uploads, templates, reference materials, and other content you provide. You represent that you have the rights and permissions needed to submit and use that content, including copyright, trademark, privacy, publicity, voice, property, and likeness permissions. If content depicts or identifies another person, you must have a lawful basis and any consent required for the requested use. A checkbox or account affirmation records your representation to Lenscap; it does not replace an actual release or permission from the rights holder.
You grant Lenscap and its service providers a limited, worldwide license to host, copy, transmit, transform, moderate, and otherwise process your content only as reasonably needed to operate, secure, and support the service, fulfill your requests, investigate failures or abuse, comply with law, and evaluate whether product features and providers are working as intended.
8. Outputs and commercial use
As between you and Lenscap, Lenscap does not claim ownership of your generated outputs. To the extent permitted by law, you own any rights that may arise in an output, and Lenscap assigns to you any rights it may acquire in that output. You may use outputs for personal and commercial purposes, including client work and paid productions, subject to these Terms, applicable law, third-party rights, and any model-specific restrictions disclosed in the product.
Outputs are non-exclusive and may resemble third-party works or outputs generated for others. Lenscap does not promise that an output is unique, eligible for copyright or other protection, accurate, or free of third-party rights. You are responsible for reviewing an output and obtaining permissions appropriate to your use. Rights in Lenscap, provider models, software, and third-party material do not transfer to you.
9. Private content and optional sharing
Lenscap may permit authorized personnel to access private prompts, uploads, and outputs when reasonably necessary for support, moderation, security, failure investigation, abuse prevention, or product and provider quality checks. Operational access does not authorize public display. Lenscap has no public customer-output feed at launch. Any future gallery or promotional sharing feature will be opt-in for each item, off by default, revocable for future display, and accompanied by a separate display license and attribution choice.
10. Acceptable use and safety
Follow the AI Content Policy. You may not use Lenscap for unlawful content, sexual material involving minors, nonconsensual intimate content, deceptive impersonation, infringement, fraud, abuse, malware, attempts to identify private individuals, or attempts to bypass safety, security, rate, or payment controls. Model providers may impose additional safety restrictions. We may reject or remove content and restrict accounts where reasonably necessary to enforce these rules.
11. Lenscap intellectual property
Lenscap and its licensors own the service, software, visual design, branding, documentation, and related intellectual property. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose. You may not reverse engineer the service except where the law does not permit that restriction, resell access, scrape protected portions, or use the service to build a competing model or dataset. Feedback may be used without restriction or compensation, but you are not required to provide it.
12. Third-party services
Lenscap uses third parties for hosting, authentication, payments, generation, moderation, analytics, and other operations. Their services can be subject to separate terms and availability. Our Subprocessors page identifies core categories and providers. Lenscap is not responsible for third-party products you independently connect or use outside the Lenscap service.
13. Suspension, termination, and deletion
You may stop using Lenscap at any time and may request account deletion. Cancellation of a subscription and deletion of an account are separate actions. We may suspend or terminate access for material violations, fraud, security risk, legal requirements, or harm to the service or others. Where reasonable, we will provide notice and an opportunity to address the issue. Certain billing, tax, fraud, security, and legal records may be retained as described in the Privacy Notice.
14. Service disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENSCAP IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS, PARTICULAR CREATIVE RESULTS, PROVIDER AVAILABILITY, OR THAT EVERY DEFECT WILL BE CORRECTED. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUDITY LABS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM LENSCAP OR GENERATED CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID LENSCAP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.
16. Indemnity
To the extent permitted by law, you will defend and indemnify Audity Labs LLC and its personnel against third-party claims, damages, and reasonable costs arising from your unlawful use of Lenscap, your content, or your material breach of these Terms. This obligation does not apply to the extent a claim results from Lenscap’s own unlawful conduct, gross negligence, or willful misconduct.
17. Governing law and disputes
These Terms are governed by Colorado law, without regard to conflict-of-law rules. Before filing a claim, contact us and make a reasonable effort to resolve it informally. Subject to mandatory consumer protections that apply in your location, claims must be brought in the state or federal courts located in Colorado, and each party consents to those courts’ jurisdiction. Nothing here prevents either party from seeking urgent injunctive relief where appropriate.
18. Changes and general terms
We may update these Terms to reflect legal, security, provider, or product changes. If a material change affects existing subscribers, we will provide reasonable notice before it takes effect when required. If part of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, or sale of the business or service.
